Agreement and Terms of Use for Yamama Website

Introduction You are reading and agreeing to these terms of use (“the terms”), which constitute an agreement between you, the platform user (referred to in these terms as “the user,” “you,” or a similar term), and us, Al-Yamama, the operator of the platform and provider of Yamama products related to our platform. We reserve the right to cancel or modify any of these terms at our sole discretion. Our right to cancel or modify these terms does not affect any other rights or remedies we may have with respect to any breach that may have occurred or any rights, obligations, or liabilities that arose prior to cancellation or modification. We reserve the right to prevent you from using the platform and/or any of Yamama’s products (or any part thereof) at any time.

Restrictions
You acknowledge and agree that you will not engage in any of the following actions on the platform (unless we have expressly permitted you to do so):
Creating multiple accounts and/or selling any account.
Creating an account with false or misleading information, or an account claiming to belong to someone other than yourself.
Posting duplicate or repetitive content, including identical or nearly identical user content in multiple sections, or in multiple areas and/or cities and/or neighborhoods.
Listing more than one product or service in a single advertisement.
Deleting and reposting the same advertisement with the intention of improving its position.
Posting content in incorrect sections.
Posting content from outside the local area or that is unrelated to the local area.
Posting generic content or content that has no direct relevance to the product or service being offered.
Completely modifying or changing an advertisement for another product or service.
Conditioning or incentivizing others to pay in advance for any goods or services before delivery.
Uploading personal images (other than those that are part of account-related information or when required by us).
Contacting anyone who has requested not to be contacted, or stalking or harassing anyone (whether using the platform or otherwise).
Communicating for commercial purposes with anyone who has not requested it, including soliciting a user to advertise on any other platform.
Collecting personal information about users or other entities for commercial or illegal purposes.
Using automated technologies, including spiders, bots, crawlers, and data mining tools, to download or scrape data, except for search engines (for example, Google) and non-commercial archives (for example, archive.org) that comply with our policies and requirements.
Imposing unreasonable or disproportionate loads on our servers and technical infrastructure.

Unauthorized attempts to access computer systems that we own or control, or engaging in any activity that disrupts or diminishes the quality of the Platform service, interferes with its performance, or impairs its functionality.

Reverse engineering any part of the Platform or making any changes to the Platform other than posting User Content in accordance with these Terms.

Restricting, or attempting to restrict, any other person’s ability to use the Platform or any of Al Yamama’s products.

Reporting any advertisement or other user without a reasonable good faith belief that the advertisement or user you wish to report has violated these Terms, applicable laws or regulations, or using any type of automated device, computer program, or other procedure (whether automated or otherwise) to report more than one advertisement or more than one user at the same time or within a short period of time without a reasonable good faith belief that the advertisement or user you wish to report has violated these Terms, applicable laws or regulations.

(y) Using any automated device or software that enables the automatic posting of publications on the Platform without human intervention or authorship (“Automated Posting Device”), including, without limitation, using any Automated Posting Device in connection with bulk postings, or the automatic submission of postings at specific times or intervals.

Hacking, or the electronic broadcasting of computer viruses or harmful code of any kind, or any computer program that facilitates unauthorized access to computer systems with the intent to harm any operating system or intercept any personal data.

You also acknowledge and agree that any user content (whether publicly available or private) that contains one or more of the following is prohibited and will be deleted:

• Illegal content, or that which violates applicable laws, regulations, and codes of conduct.
• Content that is damaging to our reputation.
• Content that is annoying, misleading, false, untrustworthy, fraudulent, that does not accurately represent the nature and use of goods and services, or intentionally misleading pricing (including those related to discounts during or after promotional campaigns).
• Content that contains personal or identifiable information about another person without their explicit consent, or that impersonates any person or entity or falsely suggests it is associated with any person or entity.
• Information that is defamatory or slanderous (or may be interpreted as such).
• Derogatory, racist, offensive, abusive, or harmful, or that may be harmful or threatening or aggressive in nature (whether directed at any individual or group or inciting violence against any individual, group, or animals), including on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability.

Alcoholic beverages, liquor, illegal tobacco products, drugs, illegal psychotropic substances, drugs, intoxicants of any kind, medicines, therapeutic/palliative substances (except for certain dietary supplements, slimming products and cosmetics, as any advertisement may be approved if we obtain assurances that the advertiser is licensed by law and that the advertisement does not violate applicable laws).

A living or dead person and/or all or any part or organ of any human being that has been preserved or preserved by any means whether artificial or natural, including blood, body fluids and/or body parts.
Pornography or pornography that includes child pornography, prostitution or any other service of its nature is intended to violate any law or regulation relating to human trafficking, representation or portrayal of women or children and the standards of morality and decency prevailing in the countries in which we operate.
Indecent and shameful material intended for use in a sexual setting (including “slavery” and “fondness” materials), or displaying sexual activity or human genitals in a “reality-like” or realistic manner.
Antiquities and art treasures that are not authorized to be sold or traded under any applicable law.

Counterfeit, pirated and/or stolen goods or illegal unauthorized services (or services that you are not licensed, are not permitted to perform or have no authority to perform).
Materials, goods and services that violate or attempt to violate intellectual property, publicity rights or moral rights or are intended to violate the personal right to privacy of any person.
Materials, goods and services the sale of which the owner prohibits or otherwise prohibits the sale or listing of.
Hazardous chemicals or pesticides.

Hazardous chemicals or pesticides.
Fireworks, destructive devices and explosives including any materials that enable the manufacture of fireworks, explosive detonators and explosive devices.
Personal identity documents, personal financial records and personal information.
Lottery tickets, raffle tickets, any equipment and machines used specifically for gambling.
Army or police insignia, uniforms, coat of arms and/or any government emblems, distinctive signs, and/or military- or police-related materials that are not permitted to be sold or traded under any applicable law.
Weapons, related materials and machinery used by the army and police (e.g. firearms, firearms parts, ammunition magazines, ammunition, tear gas, electric detonators or folded knives).

Drones and their accessories unless they are legal in the country where they are listed by the official authorities.
“Pyramid schemes”, “multi-level marketing”, “deceitful marketing”, “negative option marketing” and/or similar unsolicited advertisements of a commercial nature or scams that are only intended to defraud users or that are part of money laundering operations.
Endangered animals or animals declared for combat or offensive purposes.
Loans, financing services, and other services provided by unlicensed finance companies.
Advertisements for maids, nannies or domestic helpers unless the advertisement is from licensed offices or companies.

Announcements related to the transfer of a residence permit or similar.
Without prejudice to the foregoing, we also reserve the right to delete any advertisement or request any additional information (including the necessary licenses) before posting any advertisement, including if we receive a request to do so from any official authority, in particular:
In Egypt, advertisements for drones, small planes and drug advertisements.
In the Sultanate of Oman, according to the decisions issued by the Public Authority for Consumer Protection, including decisions related to preventing the trading of furniture made of sponges, fabrics and used clothes, cosmetics containing (lilyal), products of a burning nature for cleaning drain pipes, gel toys and slime toy, and goods containing asbestos.
In the State of Kuwait, any advertisements related to trading or mining virtual assets and currencies.
In Saudi Arabia, any ads related to Starlink equipment, use of Starlink network, laser and epilators.

In the UAE, any advertisements related to the sale of animals or transport services.
In all countries, any advertisements related to medical substances or nutritional supplements of any kind if approvals from the competent official authorities are not attached, and to Internet Protocol (IPTV) televisions.
Registration and your account
You do not need to register to use the platform. However, depending on how you use, you may need to register to continue using the Platform and you will be required to register in order to make many Yamama products available to you. Account creation is free. When you have an account, you will be able to create user content, review your research quickly and easily, have conversations with other users on the platform, and manage your account settings. We may ask users to re-verify their accounts at any time. We reserve the right to refuse to register or close any account at any time.
The registration process is very simple and will often require you to provide a username, password, active phone number or email address. We reserve the right to request additional information to improve the user experience.

Each user has the right to have only one account on the platform. Any recurring accounts will be deleted by us. If you use multiple accounts and we take action against you, we may take action towards all of your accounts.
You must keep your account password confidential and notify us immediately if any unauthorized third party becomes aware of your password, unauthorized use of your account or any known security breach that may affect your account. You agree that we are not responsible and bear no responsibility if a person to whom you have disclosed your password uses (and/or transacts by) the Platform and/or purchases any of Al Yamamah’s products. Please note that you are entirely responsible if you do not keep your password confidential.
We may send you administrative or promotional communications from time to time. We may also send you information related to your account activity and purchases, as well as updates about our Platform, Yamama products or other promotions. You can opt out of certain communications only if this feature is available to you.

If we reasonably believe or have evidence that you (or the User Content you create) have violated any of these Terms, the Privacy Policy or applicable laws, or if we reasonably suspect that you (or the User Content you create) may or will breach any of these Terms, the Privacy Policy or applicable laws, we may, without notice of any prior notice, may:
We ban or suspend your account, permanently delete or blacklist your account.
We prohibit you from using the Platform or any of the purchased Yamama products (using your account or anyone else’s account).
Prevent you from activating any purchased Yamama products, and we will not bear any liability whatsoever for our use of this right.

If we take any of the actions set forth in the preceding clause (6), we may not return the account to you until we receive assurance from you, in a manner we deem acceptable, that there will be no further breach of these Terms, our Privacy Policy or applicable laws.
We will cooperate fully with any request or directive from security or judicial authorities to disclose the identity or locate of any person who violates these Terms or applicable laws.
By continuing to use our Platform, you agree that we can at any time audit and inspect your account to investigate system errors or to investigate any potential or reported violations of these Terms and Conditions or any of our policies, rules or regulations.
You must notify us of any dispute within 48 hours of becoming aware of the problem.

We reserve the right to close an account belonging to any user and/or suspend, cancel or terminate the purchased Al Yamama products, immediately and directly if he/she violates these terms, including if he is found to be using a proxy device to hide his IP address in order to cover up his use of multiple accounts, or if a person pretends to be in a country different from the one in which he actually resides, or if he disables the platform or any of our products in any way. In this case, the User shall not be entitled to any compensation by Al Yamamah, as set out in the terms relating to the limitations of our liability and indemnity from these Terms.

Any reference to “liability” means liability for or for any act whatsoever (including breach of contract, tort, misleading, reinstatement, or any basis for claim whatsoever) relating to these Terms or arising under or in connection with these Terms (including liability expressly set forth in these Terms or arising out of the invalidity or unenforceability of these Terms).

Nothing in these Terms shall be construed as the establishment of a joint venture, partnership, or agency relationship between you and us and neither party shall have the right or authority to assume any liability, debt or cost or to enter into any contracts or other arrangements on behalf of the other party.
You may not assign, delegate or otherwise deal with all or any of your rights or any of the obligations imposed on you under these Terms without the consent of Al Yamamah. We shall have the right to assign or delegate all or any of our rights or any of the obligations imposed on us under these Terms to any other person.
We shall not be liable for any breach of our obligations under these Terms if for any reason beyond our reasonable control.
No waiver by us of our rights as a result of any breach by you of these Terms shall be deemed a waiver by us of any future breach by you of these Terms, whether the new breach is similar or different. No delay, tolerance or indulgence by us towards you shall be deemed a waiver of our rights or a relief from your obligations and shall in no way affect your liability under these Terms.

Notices and notices shall be in writing and shall be sent by e-mail to info@yamama.site.
No provision shall be deemed enforceable by any person to which it is not a party. This means that we are Al Yamama and you the only User who can enforce the provisions of these Terms.
If any provision of these Terms is found to be illegal, void, or unenforceable, that provision will be terminated without affecting the validity and enforceability of the other terms.
These Terms (and all other non-contractual relationships between you and us), depending on where you live, are subject to the provisions and interpretation of the laws.
